Terms & Conditions – The Fitness Charter

These Terms and Conditions (“Terms”) govern your use of the website and services provided by The Fitness Charter (“we”, “our”, “us”). By using our website or booking our services, you agree to these Terms.

1. Services Provided

We offer a range of health, wellness, and fitness services, including but not limited to:

  1. Sports Massage Therapy
  2. Personal Fitness Coaching (in-person, online, and hybrid)
  3. Group Fitness Sessions
  4. Consultations, assessments, reviews, and other appointment types
  5. Monthly membership packages for massage, fitness, or combined services

2. Eligibility & User Responsibilities

  1. You must be at least 18 years old to book or use our services.
  2. For any massage, therapy, fitness coaching, or other appointment provided to a minor (under 18 years), a parent or legal guardian must be present throughout the appointment and must sign informed consent on behalf of the minor.
  3. You must provide accurate and complete personal, contact, and health information.
  4. You agree to follow all safety instructions and guidance provided during appointments, sessions, and coaching programmes.

3. Health & Safety

  1. Before participating in any appointment or programme, you must complete all required consultation or health forms, including those specific to massage or fitness services.
  2. We reserve the right to refuse, adapt, or stop any service if we believe it may compromise your safety or wellbeing.
  3. Our services do not replace medical advice. Consult your GP or healthcare professional if you have any health concerns.

4. Booking, Cancellations & Refunds

4.1 General Booking

All bookings must be made via Vagaro, accessed through thefitnesscharter.co.uk.

4.2 Cancellation Policy (all appointment types)

  1. A minimum of 24 hours’ notice is required to cancel or reschedule any appointment.
  2. Cancellations made with less than 24 hours’ notice result in the deposit being non-refundable.

4.3 Deposits

A deposit is required to secure all appointments.

Late cancellations forfeit the deposit, which covers business, preparation, and scheduling costs.

4.4 Refunds

Where applicable, refunds will be issued within 14 days to the original payment method.

5. Memberships & Monthly Service Entitlements

5.1 Sports Massage & Combined Fitness + Massage Memberships

  1. Clients are responsible for redeeming their included services (massage, coaching sessions, etc.) within the relevant month.
  2. Unused sports massages or included services may be carried over for a maximum of 14 days into the next month.
  3. Any services not used within this period are forfeited, unless otherwise agreed at our discretion.

5.2 Personal Fitness Coaching Memberships

Personal Fitness Coaching memberships may include ongoing coaching, programme updates, app access, and a monthly in-person review session.

  1. Clients must book their monthly in-person review within that calendar month.
  2. If it is not booked, the entitlement is lost for that month.
  3. At our discretion, we may offer an alternative such as a phone call, video consultation, or other digital check-in, but this is not guaranteed.

5.3 Coaching Platform & Personal Data Use

Fitness coaching programmes are delivered via a third-party coaching application.

By enrolling in fitness coaching, clients consent to:

  1. An account being created for them on the app
  2. The use of the email address and any other personal details they provide (e.g., name, phone number, relevant health information) to create and manage their coaching account and communication within the app

5.4 PAR-Q & Health Declarations

Clients must complete a PAR-Q (Physical Activity Readiness Questionnaire) and any additional consultation forms provided before beginning any coaching.

If the client answers “Yes” to any PAR-Q question:

  1. They must seek appropriate medical advice before starting or continuing the programme
  2. It is their responsibility to obtain medical clearance if recommended
  3. Participation without appropriate clearance is done at their own risk

6. Massage, Coaching & Fitness Disclaimers

6.1 General Service Disclaimers

  1. Sports massage may result in temporary soreness or discomfort.
  2. Massage is not a substitute for medical treatment.
  3. Fitness and exercise carry inherent risks. By booking any service, clients confirm they understand these risks and have disclosed all relevant information.

6.2 Online Fitness Coaching – Risk & Responsibility

Online or remote coaching has inherent limitations and risks compared to in-person training. By participating in online coaching, clients acknowledge and accept that:

  1. Instruction, demonstrations, and feedback may be provided remotely and without physical supervision
  2. They are responsible for ensuring a safe training environment and using appropriate equipment
  3. They must follow all warm-up, technique, exercise, and safety guidance provided
  4. Improper form, misuse of equipment, or ignoring guidance may increase the risk of injury
  5. The Fitness Charter is not liable for injuries caused by:
  6. Failure to follow instructions
  7. Unsafe training environments
  8. Equipment misuse
  9. Independent exercise outside the prescribed programme
  10. Choosing to exercise without required medical clearance

Clients accept full responsibility for their own safety during remote coaching and independent exercise.

7. Pricing & Payment

  1. All fees are in GBP.
  2. Payments are processed securely through Vagaro.
  3. Prices may change, but existing bookings are honoured at the rate at the time of purchase.

8. Intellectual Property

All content on our website—text, media, branding, and materials—is owned by The Fitness Charter and protected by copyright law.

No content may be reproduced, distributed, or used without written consent.

9. Limitation of Liability

We are not liable for outcomes or injuries resulting from:

  1. Failure to disclose relevant health information
  2. Failure to follow instructions or guidance
  3. Unsafe training environments
  4. Individual variations in results, goals, or progress

Our total liability is limited to the amount paid for the specific service, unless required otherwise by law.

10. Marketing & Third-Party Services

We may use third-party services such as Google Analytics and Google Ads for performance tracking and advertising.

By using our website, you consent to cookies and tracking technologies in accordance with our Privacy Policy and Cookies Policy.

11. Governing Law

These Terms are governed by the laws of England & Wales.

Any disputes will be handled by the courts of England & Wales.

12. Changes to These Terms

We may update these Terms at any time.

Revisions take effect upon publication on our website.

Continued use of our services confirms acceptance of the updated Terms.
